Event Details

The automotive industry continues to grow and innovate at a rapid pace which may present challenges when it comes to protecting the best interests of the business. New types of agreements, customers, buyers and negotiation strategies have become daily topics of conversation.
 
To help seasoned supplier executives and those new to the industry gain a better understanding of various contractual agreements, the Original Equipment Suppliers Association (OESA), in partnership with Butzel Long, will host a “Supplier Legal Academy Series” designed to provide a “back-to-basics” approach for supply chain management in the current landscape, while looking ahead toward uncharted territory.
 
The June 28, 2019, academy will take place at MSU Management Education Center in Troy, Mich.. 
David Devine, shareholder, Jen Dukarski, shareholder, and Don Orlandoni, shareholder, Butzel Long, will discuss "When Contracts Go Bad" including:

  • Dealing with Bad Products
    • Acceptance, rejection, and revocation
    • Notice of breach
    • Cost recovery
  • Dealing with Supplier Threats
    • Angry lawyer letter
    • Paying under protest
    • Litigation options, injunctions and other remedies
  • Dealing with Unprofitable Programs
    • Due to tariffs, raw material costs, length of program, labor costs, etc. 

Supplier executives responsible for understanding, fulfilling and enforcing supply chain contracts should plan to attend these briefings.
